Arizona, alongside 14 other states, filed a motion in federal court late Monday seeking to prevent the end of Title 42, a pandemic-era health policy that allows border officials to swiftly expel migrants at the country’s borders.

The states, all with Republican attorneys general, filed a motion to intervene, asking U.S. District Judge Emmet Sullivan in Washington, D.C., to allow them to become part of the lawsuit regarding the health order. The Trump-era policy was invoked in March 2020 and has been used to expel migrants more than 2.4 million times since, according to U.S. Customs and Border Protection data.

Under Title 42, official ports of entry along the U.S.-Mexico border are mostly closed to asylum seekers, with a few exceptions made through humanitarian parole. Advocates and asylum seekers have decried the policy, which has impeded migrants’ ability to seek asylum in the U.S. and forced them to wait for months in Mexican border communities, facing discrimination and dangerous conditions.
